1. Purchasing Policy
1.1. Contract Formation
- A contract is formed between MiCapic and the client once the client accepts a quotation provided by MiCapic and a written agreement is signed.
- The contract will include a detailed description of the services, costs, timelines, and deliverables.
1.2. Pricing and Payment Terms
- Prices for services will be clearly indicated in the quotation.
- Payment terms will be specified in the contract. Typically, a 50% deposit is required upon signing the contract, with the remaining 50% due upon completion of the project.
- All payments must be made in euros (€).
1.3. Exceptions to Payment Terms
- Long-standing clients and governmental clients are exempt from the 50% upfront payment requirement. They can pay the full amount upon project completion.
- New and non-governmental clients are required to pay 50% of the cost upfront, with the remaining amount due upon project completion.
1.4. Amendments and Modifications
- Any changes to the scope of work must be documented in writing and agreed upon by both parties. This may affect the project cost and timeline.
2. Contract Return Policy
2.1. Right of Withdrawal
- Clients can cancel the contract and request a refund within 14 days of signing the contract, provided no work has commenced. This right applies to contracts concluded remotely or outside the company's premises, in accordance with EU consumer rights directives.
2.2. Commencement of Work During the Withdrawal Period
- If the client agrees to start work during the withdrawal period and then wishes to cancel, the refund will be calculated based on the proportion of work completed up to the date of cancellation.
2.3. Return Procedure
- Clients must submit a written request for cancellation via email or postal mail to MiCapic. The request will be processed, and the applicable refund will be issued within 14 days of receipt of the cancellation request.
3. Cancellation Policy
3.1. Cancellation by MiCapic
- MiCapic reserves the right to cancel any project at any time. In such cases, the client will receive a full refund of any payments made.
3.2. Cancellation by Client
- Clients may cancel the project by providing written notice to MiCapic.
- If the cancellation occurs before the project starts, the client will receive a full refund of any payments made.
- If the cancellation occurs after the project has started but before completion, MiCapic will refund a portion of the payment based on the amount of work completed.
- The client will bear any costs incurred for work done up to the point of cancellation.
4. Compliance with EU and Dutch Laws
4.1. Consumer Rights
- MiCapic adheres to the EU Consumer Rights Directive, which provides clients with the right to clear information, withdrawal rights, and a standard EU-wide policy for returns and refunds.
4.2. Data Protection
- MiCapic complies with the EU General Data Protection Regulation (GDPR). All client data will be handled with care, and personal data will only be used for the purposes of fulfilling the contract.
4.3. Dispute Resolution
- In the event of a dispute, MiCapic will seek to resolve the matter amicably with the client. If a resolution cannot be reached, the matter will be referred to arbitration in accordance with Dutch law.
5- Raw Materials.
The exported materials will be uploaded to Google drive, and the raw materials will be kept on Micapic servers for 6 months after the project is completed. During that period, the customer has the right to request any of the materials kept during that period.
